
Course Description
This comprehensive course in Islamic Legal Maxims (Qawaid Fiqhiyyah) provides detailed study of the fundamental legal principles that form the foundation of Islamic jurisprudence and guide the application of Islamic law. Students will learn the five major legal maxims and their numerous sub-principles, including the maxim that certainty is not removed by doubt, that hardship brings facilitation, that custom has the force of law, and that harm must be removed. The course covers the historical development of these maxims, their relationship to the primary sources of Islamic law, and their practical application in various areas of jurisprudence including worship, transactions, family law, and criminal law. Students will develop skills in applying these maxims to contemporary legal issues and understanding how they provide flexibility and wisdom in Islamic legal reasoning.
